Trusts
Trusts are widely used to hold family property and plan for the next generation. We draft and administer trust documents and attend to property transfers into and out of trusts.
Trust services
- Trust deeds: drafting inter vivos (family) trusts and advising on testamentary trusts in wills.
- Letters of Authority: lodging the trust with the Master of the High Court and applying for trustees' authority to act.
- Appointment and removal of trustees.
- Trust amendments: amending trust deeds to reflect changed family or tax circumstances.
- Beneficial ownership: keeping the Master's beneficial ownership register up to date.
- Property transactions: transfers of property into and out of trusts, including trustee resolutions and authority.
When a trust buys or sells property, the Deeds Office requires the trustees' current Letters of Authority and a valid resolution. We check these early to avoid delays at lodgement.
