Transfer duty or VAT?
Transfer duty applies when you buy from a seller who is not a registered VAT vendor, for example a private individual. If the seller is a VAT vendor selling in the course of business, such as a developer selling a new unit, VAT is payable instead and is usually included in the price.

Frequently asked questions
Who pays transfer duty?
The purchaser pays transfer duty to SARS. It must be paid before the transfer can be lodged at the Deeds Office, and in any event within six months of the date of acquisition to avoid interest.
Is transfer duty payable if I buy from a developer?
Not if the seller is a VAT vendor selling in the course of its business. In that case VAT is included in the price and no transfer duty is payable.
Is transfer duty payable on inherited property?
No. Property acquired by an heir from a deceased estate is exempt from transfer duty.
Do companies and trusts pay a different rate?
No. Since 2015 the same rates apply to individuals, companies, close corporations and trusts.
